These Terms & Conditions ("Terms") govern your access to and use of the Radiant Skincare platform operated by RADIANT SKINCARE LTD., a registered Canadian corporation (Business Number: 786024604). By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
Radiant Skincare provides salon and spa management software including booking, payments, marketing automation, analytics, client CRM, and staff management tools ("Services"). Services are provided on a subscription basis as described on our Pricing page.
Subject to these Terms, RADIANT SKINCARE LTD. grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services within the scope of your selected plan. You may not: (a) reverse engineer, decompile, or disassemble any part of the Services; (b) resell, sublicence, or redistribute the Services to third parties; (c) circumvent any technical limitations or access controls.
You must provide accurate and complete information when creating an account and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
You agree not to misuse the Services. Misuse includes, but is not limited to: (a) any unlawful, fraudulent, or deceptive activity; (b) sending spam or unsolicited communications; (c) infringing on the intellectual property rights of others; (d) interfering with the security, integrity, or performance of the Services, including introducing malware, probing vulnerabilities, or scraping data; (e) attempting to gain unauthorised access to any systems or accounts.
RADIANT SKINCARE LTD. retains all rights, title, and interest in and to the Services, including all software, documentation, branding, trademarks, and related intellectual property. Nothing in these Terms transfers any IP rights to you except the limited licence granted above.
You retain ownership of all data, images, and content you upload to the platform ("Your Content"). By using the Services, you grant RADIANT SKINCARE LTD. a limited licence to host, process, and display Your Content solely as necessary to provide the Services to you.
All prices are in Canadian Dollars (CAD). GST/HST (Registration: 78602 4604 RT0001) will be applied where applicable. Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time; access continues until the end of your current billing period.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Access to the platform requires a paid subscription. You will be charged at checkout when selecting your plan.
We strive to provide reliable access to the Services but do not guarantee uninterrupted, error-free, or secure operation at all times. The Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We may suspend or terminate your access to the Services at our discretion if: (a) you materially breach these Terms; (b) payment is overdue; (c) we reasonably believe your account poses a security or fraud risk; or (d) you repeatedly or seriously violate our acceptable use policy. Upon termination, you may export your data within 30 days, after which it may be deleted.
The Services are provided "as is" and "as available." To the fullest extent permitted by law, RADIANT SKINCARE LTD. disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, RADIANT SKINCARE LTD.'s aggregate liability arising from or related to these Terms shall not exceed the total fees you paid in the 12 months preceding the claim. In no event shall we be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence.
You agree to indemnify and hold harmless RADIANT SKINCARE LTD. from any claims, damages, or expenses arising from Your Content, your misuse of the Services, or your violation of these Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada.
We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
